This Privacy Policy describes Stellary’s policies and procedures on the collection, use and disclosure of User’s information when the User uses the Service and tells the User about his privacy rights and how the law protects User.
Stellar Limited uses personal data provided by users solely for the purpose of operating the Stellary platform and for improving the platform’s services. By authorizing on the platform and using its services, the User gives consent to the use of the present Privacy Policy.
For the purposes of this Privacy Policy, the term «Company» means Stellar Limited with the following company details:

The Company adheres to the Data Privacy Framework Principles regarding the collection, use, and retention of personal data that is transferred from the European Union and Switzerland to the U.S.
The Company made a commitment to comply with the EU-U.S. DPF Principles and relies on the European Commission’s adequacy decision for the EU-U.S. DPF to receive personal data transfers from the European Union/European Economic Area.
The Company made a commitment to comply with the UK Extension to the EU-U.S. DPF, but will not rely on the UK Extension to the EU-U.S. DPF to receive personal data transfers from the United Kingdom (and Gibraltar) until the date of entry into force of the United Kingdom’s anticipated adequacy regulations implementing the data bridge for the UK Extension to the EU-U.S. DPF.
Interpretation
The following definitions shall have the same meaning regardless of whether they appear in singular or in plural.

For the purposes of this Privacy Policy:
Account or Personal Account means a unique account created for the User to access Stellary platform.
Affiliate (For the purposes of this Privacy Policy only, be not confused with Stellary Affiliate Program) means an entity that controls, or is controlled by or is under common control with a party, where "control" means ownership of 50% or more of the shares, equity interest or other securities entitled to vote for election of directors or other managing authority.
Application refers to (Name of App), the software program provided by the Company.
Cookies are small files that are placed on User’s computer, mobile device or any other device by a website, containing the details of User’s browsing history on that website.
Country refers to: United Kingdom, Australia, China (Hong Kong)
Device means any device that can access the Stellary platform.
Personal Data is any information that relates to a person.
Service refers to the Application or the Website or both.
Service Provider means any natural or legal entity processing the data on behalf of the Company. It can be third-party companies or any persons employed by the Company to facilitate the Service, to provide the Service on behalf of the Company, to perform services related to the Service or to assist the Company in analyzing how the Service is used.
Usage Data means data which is collected automatically, either generated by the use of the Service or from the Service infrastructure itself.

User means the person accessing the Stellary platform or using the Service.

While using Stellary platform, the Company may ask the User to disclose certain personally identifiable information which is required for the User identification. Such information may include, but is not limited to:

Cookies can be "Persistent" or "Session". Persistent Cookies remain on User’s personal computer or Device when the User goes offline, while Session Cookies are deleted as soon as the User closes his web browser.

The Use of the Personal Data
The Company may use the Personal Data for the following purposes:
To provide and maintain the Stellary platform.
To manage User’s Account. The Personal Data allows the User to access different functionalities of the Stellary platform which are available for registered users.
To contact User. The Personal Data is required to contact the User by email, telephone calls, SMS, or any other form of electronic communication regarding updates or informative communications related to the functionalities, fees, terms and conditions, security updates, when this is necessary or reasonably.
To provide User with news, special offers and general information about services and events which the Company offers that are similar to those that the User has already purchased or enquired about unless User has opted not to receive such information.
To manage User’s requests: To attend and manage User’s requests to the Company.
For business transfers: The Company may use the Personal Data to evaluate or carry out a merger, divestiture, restructuring, reorganization, dissolution, or other sale or transfer of some or all of Company’s assets, whether as a going concern or as part of bankruptcy, liquidation, or similar procedures involving Personal Data held by the Company is among the assets to be transferred.

The Company may share User’s Personal Data as follows:
With Service Providers. The Company may share User’s Personal Data with Service Providers to monitor and analyze the use of the Stellary platform as well as to contact users.
For business transfers. The Company may share or transfer User’s Personal Data in connection with, or during negotiations of, any merger, sale of Company’s assets, financing, or acquisition of all or a portion of Company’s business to any third party.
Affiliates. The Company may share User’s Personal Data with Company’s affiliates, requiring them to honor this Privacy Policy. Affiliates include parent companies and any other subsidiaries, joint ventures or other companies that the Company controls or that are under common control with the Company.
With business partners. The Company may share User’s Personal Data with its business partners to offer the User certain products, services or promotions.
With other users: when the User shares Personal Data or otherwise interact in the public areas with other users, such information may be viewed by all users and may be publicly distributed outside.
With User’s consent, The Company may disclose User’s Personal Data for any other purpose with User’s consent.
The Company will retain Personal Data only for as long as is necessary for the purposes of this Privacy Policy. The Company will retain and use User’s Personal Data to the extent necessary to comply with our legal obligations, resolve disputes, and enforce our legal agreements and policies.
The Company will also retain Usage Data for internal analysis purposes. Usage Data is generally retained for a shorter period of time, except when this data is used to strengthen the security or to improve the functionality of the platform, or the Company are legally obligated to retain this data for longer time periods.
Personal information, including Personal Data, is processed at the Company's operating offices and in any other places where the parties involved in the processing are located. It means that this information may be transferred to — and maintained on — computers located outside of User’s state, province, country or other governmental jurisdiction where the data protection laws may differ than those from User jurisdiction.
Hereby the User consents to this Privacy Policy followed by submission of such information represents User’s agreement to such transfer.
The Company will take all steps reasonably necessary to ensure that User’s data is treated securely and in full accordance with this Privacy Policy and no transfer of User’s Personal Data will take place to an organization or a country unless there are adequate controls in place including the security of Uder’s data and other personal information.
The User has the right to delete or request the Company to assist in deleting the User’s Personal Data which the Company has collected.
The Stellary platform may give the User the ability to delete certain information about him from within the platform.
The User may update, amend, or delete certain User’s information at any time by signing in to User’s Account, and entering the account settings section allowing the User to manage User’s personal information.
The User may also contact the Company to request access to, correct, or delete any personal information that he has provided to the Company.
The Company may need to retain certain information if there is a legal obligation or lawful basis to retain such information.
Business Transactions
If the Company is involved in a merger, acquisition or asset sale, User’s Personal Data may be transferred. The Company will provide notice before User’s Personal Data is transferred and becomes subject to another Privacy Policy.
Law enforcement
Under certain circumstances, the Company may be required to disclose User’s Personal Data if it is required to do so by law or in response to valid requests by proper public authorities (e.g. a proper court ruling or a proper government agency).

The Stellary platform does not address anyone under the age of 13. The Company do not knowingly collect personally identifiable information from anyone under the age of 13. If someone is a parent or guardian or trustee and he is aware that a child has provided the Company with Personal Data, please contact the Company. If the Company become aware that it has collected Personal Data from anyone under the age of 13, the Company will take all proper steps to remove such information from Company’s servers.
If the Company needs to rely on consent as a legal basis for processing User’s information and User’s country requires consent from a parent, the Company may require parent's consent before collecting and using such information.
The Stellary platform may contain links to other websites that are not operated by the Company and its affiliates. If the User clicks on a third-party link, the User will be directed to that third party's site. The User is strongly advised to check and review the Privacy Policy of every site.
The Company has no control over and assume no responsibility for the content, privacy policies or practices of any third-party sites or services.
The Company may update this Privacy Policy from time to time. The Company will notify the User of any changes by posting the new Privacy Policy on this page.
The Company will inform via email and/or a prominent notice on the Stellary platform, prior to the change becoming effective and update the "Last updated" date at the top of this Privacy Policy.
The User is advised to review this Privacy Policy periodically for any changes. Changes to this Privacy Policy are effective when they are posted on this page.
